Power of Attorney

The delegation of decision making powers due to issues such as absence abroad, lack of capacity due to sickness or age related mental deterioration require consideration as to the nominee(s) and the limitations (if any) of the circumstances in which such delegated power can be exercised. It should also be noted that:

  •  The terms of the document need to be drafted to ensure that full range of powers that should be subject of the appointment have been captured; and
  • Recent legislative changes to the required documentation now also apply.
